Madam Sew Terms of Service

Important: section 12 requires most disputes to be resolved by individual arbitration, not in court, and waives class actions. You can opt out within 30 days (section 12.7).

1. Who we are and accepting these terms

madamsew.com is operated by STARGAU LLC, 1050 E Flamingo Road, Suite 107-2096, Las Vegas, NV 89119, USA ("Madam Sew", "we", "us").

You accept these Terms when you place an order, create an account, sign up for emails or texts, or check the box or click the button that refers to them. Our Privacy Policy (madamsew.com/policies/privacy-policy), Shipping Policy (madamsew.com/policies/shipping-policy) and Refund Policy (madamsew.com/policies/refund-policy) are part of these Terms.

You must be at least 18, or the age of majority where you live, to buy from us.

2. Orders, prices and payment

Your order is an offer to buy. We accept it when we ship it. We may cancel or limit an order, for example for stock, pricing errors or suspected fraud. If we cancel after charging you, we refund you.
Prices are in US dollars and exclude taxes and shipping unless stated. We may correct errors at any time.
Colors and product images may vary slightly from the real product.

3. Shipping, returns and warranties

Shipping times, costs and our return window are set out in our Shipping Policy and Refund Policy. Any product warranty is stated on the product page or packaging. Nothing in these Terms limits rights you have under law that cannot be waived.

4. Promotions, free gifts and discount codes

Free gifts, bundles and discount codes are subject to the rules shown with the offer. They are limited to stock, one per order unless stated, have no cash value and may end without notice. If you return items needed to qualify for a gift or discount, we may deduct its value from your refund.

5. Accounts

Keep your login details secure. You are responsible for activity on your account. Tell us at hello@madamsew.com if you think it has been misused.

6. Email and text messages

If you sign up for texts, you agree to receive recurring automated marketing messages at the number you gave. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to stop, HELP for help. The full SMS terms are linked on every text message sign-up form.

7. Chat, calls and site monitoring

You agree that we and our service providers may record, store and review your chat conversations, calls and emails with us, and your use of our site as described in our Privacy Policy, including through cookies, pixels and session-recording tools, subject to the cookie choices you make. We do this to serve you, keep records, prevent fraud and improve the site.

8. Reviews and content you send us

If you post a review, photo or other content, you confirm it is yours and truthful, and you give us a non-exclusive, royalty-free, worldwide license to use, display and share it in connection with Madam Sew, including in ads, with credit where practical. We may remove content at our discretion.

9. Using our site

All content on the site (text, images, videos, patterns, logos, designs) belongs to us or our licensors. You may use it for personal, non-commercial purposes only. You may not: copy or resell our content or products for commercial purposes without permission; scrape, crawl or use bots on the site; interfere with its security or operation; place orders for resale in breach of any purchase limits; or use the site for any unlawful purpose.

10. Disclaimers

The site and our products are provided "as is" and "as available", except for any written product warranty and rights you have under law that cannot be excluded. We do not promise the site will always be available or error-free. Follow the instructions and safety notes that come with our products, including for irons, cutters and blades.

11. Limitation of liability and indemnity

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or lost profits. Our total liability for any claim relating to the site or a product is limited to the amount you paid for that product, or $100 if the claim does not involve a purchase. Some places do not allow these limits, so they may not apply to you.

You agree to cover our reasonable losses caused by your breach of these Terms or your misuse of the site.

12. Dispute resolution: arbitration and class action waiver

12.1 Talk to us first. Before starting any claim, send a written notice to hello@madamsew.com and to our address above, with your name, contact details, order number if any, a description of the problem and what you want. We will try to resolve it within 60 days. Neither side may start arbitration or a lawsuit during that period. Time limits for claims are paused during it.

12.2 Arbitration. If we cannot resolve it, you and Madam Sew agree that any dispute relating to these Terms, the site, our products, marketing messages or your personal information, including privacy, tracking, recording and wiretapping claims under any law, will be resolved by binding individual arbitration, not in court. The arbitration will be run by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (adr.org). The Federal Arbitration Act governs this section.

12.3 Exceptions. Either side may bring an individual claim in small claims court. Either side may ask a court to stop misuse of intellectual property.

12.4 Class action waiver. Claims may be brought only individually, not as a plaintiff or class member in any class, collective or representative action. The arbitrator cannot combine claims of different people. Where the law does not allow this waiver for public injunctive relief, that request will be decided by a court after the arbitration, and the rest stays in arbitration.

12.5 Mass filings. If 25 or more similar claims are filed by or with help from the same law firm or coordinated group, they will be handled in batches of up to 25, with one arbitrator per batch. Fees and filings for later batches are paused until earlier ones are decided. This helps resolve claims efficiently and fairly.

12.6 Costs and place. We will pay filing and arbitrator fees beyond what you would pay to file in court, unless the arbitrator finds the claim frivolous. The hearing may take place by video, by phone, in writing, or in the county where you live.

12.7 Your right to opt out. You can reject this section 12 by emailing hello@madamsew.com within 30 days of first accepting these Terms, with the subject "Arbitration opt-out" and your name and email. Opting out does not affect the rest of these Terms.

12.8 If part of this section is invalid. If the class action waiver is found unenforceable for a claim, that claim goes to court, not to class arbitration. The rest of section 12 still applies.

13. Governing law

These Terms are governed by the laws of the State of Nevada and US federal law, without regard to conflict-of-law rules. Any matter not subject to arbitration will be heard in the state or federal courts in Clark County, Nevada, unless your local consumer law requires otherwise.

14. Changes and general terms

We may update these Terms and will post the new version with a new date. Changes do not apply to disputes already notified to us. Changes to section 12 apply only if you accept them, for example with a later order. If a part of these Terms is invalid, the rest stays in force. We may assign these Terms to a buyer of our business.
